• Website refers to FitNSipLive, accessible from https://fitnsiplive.com.
• You means the individual accessing or using the Service, or the company or legal entity on behalf of which such individual is accessing or using the Service, as applicable.

These Terms govern the use of our Service and form a legally binding agreement between You and Dreemzy LLC, DBA Fit N Sip Live. Your access to and use of the Service is conditioned on Your acceptance of these Terms. If You do not agree with any part, You may not access the Service.

Termination

Governing Law

These Terms shall be governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

Dispute Resolution, Arbitration, and Class Action Waiver

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will be conducted in Michigan, United States, unless otherwise required by law.

Class Action Waiver: You and Dreemzy LLC / Fit N Sip Live agree that any claims shall be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. By agreeing to these Terms, you waive any right to participate in a class action or similar proceeding.

Jury Trial Waiver: You and Dreemzy LLC / Fit N Sip Live waive the right to a jury trial in any litigation arising from these Terms or the Service.

United States Legal Compliance

You represent and warrant that You are not located in a country subject to U.S. embargo or listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Failure to enforce a right or provision shall not constitute a waiver.

Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.

The Fit N Sip Live mobile message service (the "Mobile Service") is operated by Dreemzy LLC / Fit N Sip Live DBA. By using the Mobile Service, You agree to these Mobile Terms.

• You agree to receive recurring automated SMS/text messages from Dreemzy LLC / Fit N Sip Live at the phone number You provided. Messages may be sent using automated technology. Message frequency varies.
• Messages may include: account alerts, order updates, event reminders, promotions, cart recovery, and marketing campaigns.
• Consent to receive messages is not a condition of purchase. Participation is voluntary.
• We do not charge for the Mobile Service, but message and data rates may apply based on Your wireless provider’s plan.
• You may opt out at any time by replying STOP to FITNSIPLIVE or clicking the unsubscribe link (if available). You will receive one confirmation message after unsubscribing.
• For help, text HELP to FITNSIPLIVE or email [email protected].
• Wireless carriers are not responsible for delayed or undelivered messages.
• You agree to provide a valid mobile number. If Your number changes, You must re-subscribe with the new number.
• We are not liable for failed, delayed, or misdirected delivery of messages or actions You take in reliance on such messages.
• We may change any short code or phone number used for the Mobile Service at any time and will notify You of such changes.
